Legionella in Care Homes — A Duty of Care You Can't Afford to Ignore

Care homes face a uniquely elevated legionella risk. The combination of complex water systems, vulnerable occupants and the sheer number of water outlets creates conditions that demand rigorous management. And the consequences of getting it wrong in a care home are more severe than in almost any other setting.

Residents in care homes are disproportionately affected by Legionnaires' disease. Older people, people with chronic respiratory conditions, immunocompromised individuals and those with reduced mobility are all at significantly higher risk of contracting the disease and of developing severe complications. The mortality rate for Legionnaires' disease in the general population is around 10-15%. In care home populations, it can be considerably higher.

Why Care Homes Are High Risk

Several factors combine to make care homes one of the highest-risk settings for legionella:

Complex water systems. Care homes typically have extensive hot and cold water distribution networks serving dozens or hundreds of outlets across multiple floors and wings. Long pipe runs, multiple risers and distant outlets mean water temperatures can fall into the danger zone (20-45°C) before reaching the tap.

Infrequently used outlets. Rooms that are temporarily unoccupied, seasonal facilities, rarely used bathrooms and overflow bedrooms all create stagnation risks. In a care home where occupancy fluctuates, maintaining a consistent flushing regime for every outlet is a significant operational challenge.

Vulnerable occupants. The people living in care homes are the most vulnerable demographic for Legionnaires' disease. Elderly residents with weakened immune systems, chronic lung conditions and reduced cough reflexes are at dramatically higher risk than the general population.

Assisted bathing and showering. Many care home residents require assisted bathing, which means prolonged exposure to water aerosols from showers and baths. The longer the exposure to contaminated aerosol, the higher the infection risk.

Temperature management challenges. Care homes face a genuine tension between legionella control and scald prevention. Hot water needs to be stored at 60°C and distributed at 50°C to control legionella, but water delivered at these temperatures poses a serious scald risk to vulnerable residents. Thermostatic mixing valves (TMVs) are the solution, but they need proper installation, commissioning and regular maintenance.

The Legal Framework

Care homes must comply with the Health and Safety at Work Act 1974, the L8 Approved Code of Practice, and the associated HSG274 technical guidance. The Care Quality Commission (CQC) also includes water safety within its inspection framework, and poor legionella management can result in regulatory action by both the CQC and the local authority.

The duty holder — typically the care home provider or registered manager — must ensure a legionella risk assessment is carried out by a competent person, a written scheme of control is implemented, routine monitoring is carried out and recorded, and the assessment is reviewed at least annually and after any significant changes.

Essential Control Measures

For care homes, the control measures go beyond the standard commercial building requirements:

Temperature control. Hot water stored at 60°C minimum, distributed at 50°C minimum to sentinel outlets, with TMVs fitted at point of use to prevent scalding. Cold water must remain below 20°C. Monthly temperature monitoring at sentinel and representative outlets, with records kept.

TMV management. Every TMV must be identified, regularly maintained, and checked to ensure it's operating within safe parameters. A failed TMV that allows water at 55°C+ to reach a vulnerable resident can cause life-changing burns in seconds.

Flushing regime. All outlets must be used regularly. For rooms that are unoccupied, a weekly flushing programme must be in place — running both hot and cold water for at least two minutes per outlet. This needs to be documented with dates, times and who carried it out.

Tank inspections. Cold water storage tanks must be inspected annually, cleaned when necessary, and maintained in good condition with properly fitted lids, insect screens and overflow arrangements.

Calorifier maintenance. Hot water calorifiers should be inspected and drained annually to remove sediment, with temperatures verified at the base and top of the vessel.

Water sampling. Routine microbiological sampling may be appropriate for care homes, particularly if there's any suspicion of legionella proliferation or if the water system has features that are difficult to control.

The CQC Dimension

The CQC assesses water safety under Regulation 12 (Safe care and treatment) and Regulation 15 (Premises and equipment). Inspectors expect to see a current legionella risk assessment, evidence of ongoing monitoring and record-keeping, a documented written scheme of control, training records for staff responsible for water safety tasks, and evidence that findings and actions are being addressed.

A care home that cannot produce these documents during a CQC inspection faces potential enforcement action — which can affect the home's overall rating and, ultimately, its ability to operate.

The Bottom Line

Legionella management in care homes isn't just a compliance exercise — it's a fundamental part of protecting the most vulnerable people in society. The risk is real, the consequences are severe, and the regulatory scrutiny is intense.

A thorough risk assessment by a competent person, followed by diligent implementation of the control measures, is the foundation. It's not optional, and in a care home setting, it's not something that can be done casually.
